Fashion & Polo Classic Event Waiver
By purchasing tickets to the Atlanta Fashion and Polo Classic event you hereby grant the following permissions
Waiver:
Employee, Company, Guest, and Business waiver of liability assumption of risk and indemnity agreement
In consideration of my entering the premises at Atlanta Regional Polo Center 4563 Polo Lane, Atlanta, GA 30339 (the premises) during the course of the Coronavirus pandemic, and all other occasions, I for myself, my heirs, personal representative or assigns, DO HEREBY RELEASE, WAIVE, DISCHARGE, AND CONVENANT NOT TO SURE Fashion and Polo Classic, It’s owners, officers, employees, volunteers from ANY AND ALL CLAIMS AND LIABILITY INCLUDING NEGLIGENCE resulting in personal injury, accidents, or illnesses (including death) arising from entering the premises for the purpose of employment, attending event; participating in activities, drinking, eating, dancing, watching fashion show, polo match, and other forms of entertainment etc. alone or with other patrons of Atlanta Fashion and Polo Classic (individually and collectively referred to herein as the “activities”).
Assumption of risk:
During the course of the CORONAVIRUS PANDEMIC, and all other occasions, engaging in activities carries with it certain inherent risks that cannot be eliminated regardless of the care taken by
Fashion and Polo Classic to avoid the spread of the virus. I know, understand, and appreciate that these and other health risks are inherent by participating in the activities. I HEREBY ASSERT THAT MY PARTICIPATION IN THESE ACTIVITIES ARE VOLUNTARY AND THAT I KNOWINGLY ASSUME ALL RISKS.
Indemnification and Hold Harmless:
I also agree to INDEMNIFY AND HOLD FASHION AND POLO CLASSIC from any and claims, actions, costs, expenses, damages, and liabilities including attorney’s fees as a result of my entering the premises.
Severability:
The undersigned further expressly agrees that this WAIVER of LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT is intended to be a broad and inclusive as is permitted by the laws of the state of Georgia and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Acknowledgement of Understanding:
I have read this waiver of liability, Assumption of Risk, and indemnity Agreement, and fully understand its terms. I acknowledge that by purchasing tickets to the Atlanta Fashion and Polo Classic event I am signing this AGREEMENT freely and voluntarily and intend by my purchase to be a complete and unconditional release of all liability to the greatest extent allowed by law. UNDERSTANDING THE DANGERS OF SPREADING THE CORONAVIRUS, BY EXECUTING THIS AGREEMENT, GUEST, AND ATTENDEES HEREBY CERTIFIES THAT HE/SHE HAS NOT BEEN DIAGNOSED WITH CORONAVIRUS AND HAS NOT EXPERIENCED ANY SYMPTOMS OF THE VIRUS
Photographs and Video Consent, Waiver, Indemnity and Release
Photographs, Videos and Recordings
By purchasing tickets to the Atlanta Fashion and Polo Classic I hereby grant permission to Atlanta Fashion and Polo videographers/ photography production teams and its representatives to take photographs or videos of me and to make recordings of my voice at the event or location noted below for reality show.
Production/Location Renaissance Midtown Atlanta and Atlanta Regional Polo Center: Date 10/9-10/11
I further grant to the producers and their representatives the right to reproduce, use, exhibit, display, broadcast and distribute and create derivative works of these images and recordings in any media now known or later Developed. I acknowledge that __Fashion and Polo Classic____(VIDEO PRODUCER) owns all rights to the images and recordings.
Waiver, Indemnity and Release
I hereby waive any right to inspect or approve the use of the images or recordings or of any written copy. I further waive all moral rights. I also waive any right to royalties or other compensation arising from or related to the use of the images, recordings, or materials. I hereby release, defend, indemnify and hold harmless the producers from and against any claims, damages or liability arising from or related to the use of the images, recordings or materials, including but not limited to claims of defamation, invasion of privacy, or rights of publicity or copyright infringement, or any misuse, distortion, blurring, alteration, optical illusion or use incomposite form that may occur or be produced in taking, processing, reduction or production of the finished product, its publication or distribution. I am 18 years of age or older and I am competent to contract in my own name. I have read this document before signing below, and I fully understand the contents, meaning and impact of this consent, waiver, indemnity, and release. This consent, waiver, indemnity, and release is binding on me, my heirs, executors, administrators and assigns.
